1. Investigation of your case

By requesting a case evaluation, you will be put in touch with a member of our legal team to obtain information about your potential claim. An experienced prescription drug, medical device, or product lawyer attorney will review the facts surrounding your case to determine if you have a potential claim. Our legal team can answer any questions or concerns you may have.

2. Retaining an attorney with no upfront fees or expenses

Once you decide that you wish to move forward with your potential claim, we will forward a contingency fee retainer agreement, which must be signed and returned to our office so that we can move forward and pursue a recovery. This will form the attorney-client relationship.

The contingency fee retainer agreement will confirm that there are no fees or expenses unless we obtain a recovery for you.

3. Representation and compensation

Once the contingency fee retainer agreement is signed and returned to our office, your potential claim will be pursued. Depending on the type of litigation, we will need show proof of your prescription drug use, identification of the medical device, or defective product and documentation of your injury. We will take care of obtaining the necessary medical records to pursue your claim. We may associate with specific co-counsel who have certain expertise necessary for your claim at no additional cost.

Companies that manufacturer medications and medical devices have a duty to make sure that their products are not unreasonably dangerous and defective for the consumer. If a product is defectively designed, contains a manufacturing defect, or if the manufacturer failed to adequately warn about the risks and side effects, the manufacturer can be made liable for damages that are caused as a result of their product.

Common allegations raised in prescription drug, medical device, and product lawsuits

  • Failure to adequately warn about the risks of injury and side effects;
  • Providing false and misleading information about the safety or efficacy of the prescription drug, medical device, or product;
  • Failures to update the warnings or issue a recall after serious adverse events first become apparent or after new scientific studies are published;
  • Failure to pursue safer alternative designs;
  • Failure to properly research the risks of the prescription drug or medical device prior to marketing.

All settlement offers are reviewed with you in detail and you make the final decision whether to accept any offer. After a settlement offer is accepted or a verdict is obtained at trial, you will be provided with a detailed report outlining the disbursement of all funds.
